As long as the emissions are kept within the required range, It is legal

I understand but because the engine in question is much older it may not be legal in some places.

Could be an issued depending on where you are located. Would be wise to look at the laws in your location.

In Colorado from '82 (I think), on the engine has to be the same year or newer and have all the emissions equipment for the vehicle year. Pre '82 you can pretty much do whatever as long as it passes the sniffer.
